I'm writing to request information under the Freedom of Information Act regarding section 106 agreements tied to approved planning applications.
Specifically, I would like to request data regarding applications where developer obligations - such as financial contributions towards affordable housing, local infrastructure, public open spaces, education, highways or community facilities - were varied, reduced or removed following initial planning consent.
Please provide the following information for the financial years 2021/22, 2022/23, 2023/24, 2024/25, and 2025/26 to date:
• Number of Applications: How many formal applications/requests were submitted under Section 106A of the Town and Country Planning Act 1990 (or via Deed of Variation) seeking to modify, reduce, or remove S106 developer contributions or commitments?
• Approved Modifications: How many of these applications to reduce or remove S106 commitments were approved by the Council?
• Details of Approved Variations (where held): For each approved modification, please provide:
o The planning reference number and site address.
o The original S106 contribution/obligation that was varied or removed (e.g., affordable housing allocation, cash contribution for highways/schools).
o The justification cited for the change (e.g., scheme viability/financial viability assessment).
o The total monetary value of contributions lost or waived as a result of the variation, if calculated.
