I am writing to submit a request under the Freedom of Information Act 2000.
I wish to obtain a full copy of the Section 106 Agreement associated with planning application:
• Application Reference: 18/00752/ESO
• Site: Kennett Garden Village, Land Southwest Of 98–138 Station Road, Kennett
• Developer: Bellway Homes Limited (Eastern Counties)
This request should include:
1. The complete S106 Agreement, including all signed schedules and appendices.
2. The Open Space Adoption and Maintenance Schedule, specifying:
• Long-term maintenance responsibilities
• Any management company obligations
• Any intended transfer to the District or Parish Council
3. Any subsequent deeds of variation relating to the same development.
4. Any associated plans or maps referenced within the agreement (e.g., open space plans, SUDS plans, public realm areas).

The Public Open Space for Phase 1 of the development is to be adopted by Kennett Community Land Trust, as detailed in the approved Public Open Space Scheme referenced in answer to C. The terms of transfer are defined as part of the S106 Agreement under Schedule 2 Part 2 (also see the relevant Definitions under Clause 1 of the S106 Agreement).
East Cambridgeshire District Council has no records of any transfer agreements at the time of response.
